OUR AGREEMENT WITH YOU

HPS TRANSPORT Ltd owns and operates this website under the Stella Gold & Silver trade mark, also known on this page as "we" and "our". These Terms specify the terms and circumstances under which you may use our website and the services we provide. This website provides visitors with gold and silver jewellery. By accessing or using our service's website, you acknowledge that you have read, understand, and agree to be governed by these Terms.
These are the terms and conditions on which we supply products to you.

1. Methods by which we shall process your order. Upon confirming your order via email, we will consider it accepted; at that point, you and Stella Gold & Silver will enter into a contract with legal effect.

2. Order confirmation. When we confirm receipt of your order, we will provide you with the order number associated with it in the order confirmation email. If possible, please include the order number in any correspondence regarding your order.

 

3.  If it is not possible to fulfil your order. If we are unable to fulfil your order, our customer service department will notify you via email or in writing, and you will not be charged for the product. Possible causes for this situation encompass, but are not restricted to the following: the product being unavailable; the stock failing our quality control procedures; unforeseen resource constraints that were not foreseeable; an error in the product's price or description; or our inability to adhere to a specified delivery deadline.

PRODUCT INFORMATION:
We have taken reasonable steps to accurately display the colours and other details of our items. However, the colours and detailing you see onscreen will be determined by the technology you use to view the products. We cannot guarantee that the colour or other detailing displayed on your television or computer monitor will exactly match the colour or detailing of the goods when delivered. Any information about product sizing, including stone size, is provided as a reference only. The size and specifications may also vary slightly. If you are unsure about the size of any goods you desire, we recommend contacting us before placing an order.

PRODUCT DELIVERY

The cost of the delivery costs is displayed on our website.

 

Product delivery date. We will notify you of delivery dates in our confirmation email and during the order process. We'll also email you when we ship and how to monitor your order.


We are not liable for external delays. If an event beyond our control delays our product supply, we will notify you as soon as feasible and take steps to minimise the delay. We cannot be held accountable for this type of delay.

CHANGES OF THE CONTRACT

We are unable to accommodate modifications to orders that have already been placed. After you receive your order, you can return it; for more information, see our Returns section.

CONTRACT TERMINATIONS RIGHTS

You can terminate your contract with us at any time. If you choose to do so, please contact us via email and read about the various circumstances for terminating the contract outlined below. There are different rights of ending the contract depending on the circumstances dependent on what you bought, if it's defective, our performance, and when you decided to stop the contract:

If the product you purchased is defective or misrepresented, you may have the right to terminate the contract, get it repaired or replaced, or receive a refund. Please tell us about the problem via email and review the section 'A BRIEF SUMMARY OF YOUR LEGAL RIGHTS'.

If you want to terminate the contract due to something we have done or have informed you we will do, the reasons are an upcoming modification to the product we have told you about and you do not agree (including any errors in descriptions), severe delays beyond your control, or something we have done incorrectly.

Using your right to change your mind (Consumer Contracts Regulations 2013). You have the legal right to change your mind and get a refund within 14 days. However, if the product(s) have been worn and are not in their original packaging you can not exercise your right to change your mind.

 

You may terminate the contract early, but you may be required to pay us compensation if we are not at fault and you have no right to change your mind. When products are delivered and paid for, the contract is considered complete. Contact us to cancel a contract early if we are not at fault and you have not changed your mind. The contract terminates immediately, and we will refund any payments you paid for products that were not provided; however, we may deduct reasonable compensation for the net costs we will incur as a result.

OUR CONTRACT TERMINATION RIGHTS

If you violate the terms of the contract, we may terminate it. We may terminate the contract in writing if you do not make timely payments, do not supply relevant information within a reasonable time (e.g. delivery address), or do not allow us to deliver the products you purchased; or you purchased fraudulent or unlawful conditions.

We need to be reimbursed for contract breaches. If we terminate the contract in the conditions outlined in 'Our Contract Termination Rights', we will refund any advance payments for products not delivered, but we may deduct or charge you reasonable compensation for the net costs we may incur as a result of your breach.

RETENTION OF THE RIGHTS TO CHANGED OFFERING

We may change the services without prior notice; discontinue the services or any parts of the services we offer; or impose limits on the services. We may terminate or suspend access to the services permanently or temporarily, with or without notice or liability, for any or no reason.

PRICE AND PAYMENT

Where can I locate the product's price? The price of the product (including VAT) will be the price displayed on the order pages when you place your order. We take all necessary precautions to ensure that the pricing of the product recommended to you is accurate. However, even with our best efforts, some of the things we sell may be improperly priced. We will typically check pricing before accepting your order so that if the product's correct price at the time of your order is less than our quoted price, we will charge the lesser amount. If the exact price of the goods at the time of your order is higher than the price quoted to you, we will contact you for instructions before accepting your order. If we accept and process your order with an evident and unmistakable pricing error that you may reasonably have identified as mispricing, we may terminate the contract, refund any amounts you have paid, and seek the return of any items given to you.

You can make payments with Visa, MasterCard, Maestro, PayPal, Apple Pay, or Google Pay during checkout. Our website's checkout lists approved credit and debit cards. We may cancel your order if your card or payment provider does not authorise it. Once Stella Gold & Silver receives full payment for your order, including taxes, shipping, and other fees, you will own the Products. The Products are your responsibility upon delivery or collection. All credit/debit card and Apple Pay payments on our website are conducted by Wix Payment. PayPal is processed through their own Wix connectors. Stela Gold & Silver accepts no liability for the availability and performance of this service.
